A temporary restraining order has been granted after being filed by Ergo Produce Inc., McAllen, TX, against Produce Depot LLC, McAllen, under the Perishable Agricultural Commodities Act.
According to the complaint filed April 25, Ergo Produce sold six lots of tomatoes to Produce Depot for $84,803, which remains unpaid.
Blue Book reported two updates on Produce Depot: April 25, “temporary restraining order or injunction granted”; and April 23, “reported suspended operations, obligations reported not fully liquidated.”
Companies have filed three claims against Produce Depot with Blue Book. One, from a produce company with claim amount for $123,923 was closed, but there are two open: from a produce company for $28,961 and another from a produce company for $31,840.
PACA lists Produce Depot as active, but there are two informal reparation complaints against the company.
Oscar Gomez and Irma Garcia are listed as principals.
Produce Depot’s website is under construction, but according to its Blue Book listing, the company imports and ships tomatoes, avocados, peppers, onions and other items. No one at the company could be reached for this story.
